    BUSH LEGACY

    Gone But Not Forgotten

     

    It has now been three months since President Bush and his family boarded their plane back to Texas and handed the reins of power over to President Obama. Yet Bush administration officials are pushing to make sure that the American public remembers them -- or rather, remembers what they want them to remember. While Bush has been focusing on fundraising for his presidential library and hitting the lecture circuit, his top aides have been aggressively taking to the airwaves to criticize Obama. With Obama's approval rating still above 60 percent, these aides are pulling out all the stops to shape Bush's legacy and pass blame on to his successor. However, there's little proof that these attacks are working. In a recent C-SPAN poll of presidential historians, Bush made a list of the top 10 worst presidents in U.S. history. Even abroad, officials are attempting to hold the Bush administration accountable. Last month, a Spanish court "agreed to consider opening a criminal case against six former Bush administration officials...over allegations they gave legal cover for torture at Guantanamo Bay."

    THE DECIDER: Even while still in office, Bush was looking forward to making a "ridiculous" amount of money on the lecture circuit. According to his bio on the Washington Speakers Bureau website, the point of his speaking tour is to promote his policies that were "controversial at times" but "kept the country safe for more than seven years." Bush is now lecturing approximately once a week. His first appearance was in Canada, where activists and human rights lawyers tried to bar his entry into the country. Bush has also been working to raise $300 million for his presidential library, although "the prospect" of being identified "in perpetuity" with Bush's agenda "freezes the blood" of some of Southern Methodist University's leading academics. Even though he is writing a book on his time in office, Bush is not sitting around and reflecting on his missteps and regrets. "He's secure in the place he's in. He's confident in the decisions he made. There's none of that 'Shoulda, woulda, coulda,'" said former aide Dan Bartlett. One event that Bush is trying to wipe from the American public's minds is the Iraq war. His advisers have said that the war is "unlikely" to be one of the topics of focus at the presidential library; in fact, Bush's official 483-word bio on the library website doesn't have a single mention of Iraq. A newly released five-minute promo video for the library mentions the word "Iraq" just once, although it devotes a full 35 seconds to clips showing extensive footage of 9/11 and Bush's subsequent reaction.

    THE LOYAL BUSHIES: Finding work has been tough for many former loyal Bushies. A Washington job recruiter estimated that only "25% to 30% of ex-Bush officials seeking full-time jobs have succeeded," a rate that is "much, much worse" than when Ronald Reagan, George H.W. Bush, and Bill Clinton left office. Former Attorney General Alberto Gonzales has been one of the most high-profile job seekers; he has blamed his troubles on the "rough economy" rather than his incompetence while in the Bush administration. Others have been lucky enough to stay in the public light by appearing on cable news. Fox News contributor Karl Rove continues to use his platform to attack the Obama administration -- even though Bush has said that Obama deserves his "silence." Last week, for example, Rove called Vice President Biden a "blowhard" and a "liar." He also went after Obama for praising the "Turkish secular movement" while abroad, even though Bush did the same thing while in office. Former chief of staff Andrew Card's objections have been less substantive, focusing on the fact that unlike Bush, Obama does not require his staff to wear a jacket at all times in the Oval Office. In January, Card said that the new dress code showed a lack of "respect" for the office and created a "kind of locker room experience." Most recently, the President's brother, former Florida governor Jeb Bush, has made headlines for telling Obama to leave his brother alone. "If I had one humble criticism of President Obama, it would be to stop this notion of somehow framing everything in the context of, 'Everything was bad before I got here,'" Jeb Bush told Fox News's Sean Hannity last week, not noting that his brother also repeatedly attacked Clinton. In addition to attacking Obama, these Bushies have banded together to create a Bush-Cheney Alumni Association, committed to "help build a lasting legacy for President George W. Bush and the Bush-Cheney Administration."

    SAME OLD DICK: The former vice president has been one of Obama's loudest and most controversial critics. On March 15, Cheney received widespread attention -- and criticism -- for saying that Obama is "making some choices that, in my mind, will, in fact, raise the risk to the American people of another attack." Senior White House Adviser David Axelrod responded that although Bush has "behaved like a statesman...I just don't think the memo got passed down to the vice president." Both Biden and Attorney General Eric Holder similarly came out and condemned Cheney's comments. Cheney is also up to his old secrecy tricks, refusing to transfer his records and gifts to Bush's presidential library. Next week, top administration officials will be gathering in Dallas for a reunion with the ex-president. One person who won't be there? Cheney, who is still reportedly at odds with Bush over his decision not to pardon Scooter Libby.

    Who'll Play Defense?

    Midterm elections are rarely a referendum on the party out of power. by Charlie Cook

     

    A senior Democratic strategist observed last week that at this stage in the 2006 and 2008 election cycles, he had some inkling that the political environment would be favorable for his party on Election Day. Today, though, he has no idea whether Democrats will be playing offense or defense in November 2010.

     

    Midterm elections are usually a referendum on the president and his party. And right now, President Obama is certainly no liability: His job-approval ratings average about 60 percent and hit 66 percent in a just-released CBS News/New York Times survey. These are solid numbers for a new president.

    The budget package apparently took a bit of a toll on the popularity of congressional Democrats.

    An analysis of the Gallup Organization's nightly tracking surveys, which over the course of a week poll about 3,500 adults, shows that for seven consecutive weeks Obama's job-approval rating has been in a very tight range -- from 61 percent to 64 percent. Attitudes toward the president's performance are holding remarkably stable across the 40 demographic and political subgroups measured. For example, among Democrats, Obama's approval rating consistently lands within 2 percentage points of 90 percent, among independents within 3 points of 60 percent, and among Republicans within 4 points of 31 percent.

     

    Americans who like Obama, think highly of him, and wish him well are sticking with him. His critics aren't changing their stripes, either. And the initially undecided are gradually choosing sides.

     

    In the CBS/Times poll, 63 percent of respondents said that Obama was more likely than congressional Republicans to make the right decisions about the economy. Just 20 percent disagreed. Sixty-one percent said that Obama was more likely than congressional Republicans to make the right decisions about keeping the nation safe. Twenty-seven percent disagreed.

    For now, the public largely perceives Obama as trying to get the country out of an economic mess that he didn't create. And, perhaps largely as a result, his approval ratings are higher than the share of the vote he received in November.

     

    Inevitably, if the economy doesn't begin to recover, he will be assigned full ownership of the problem. Politically, Obama needs the economy to be clearly bottoming out by early next year and showing signs of recovery in the second half of the year.

     

    Among economists these days, the new buzz phrase is "green shoots," meaning signs of new growth amid all the economic deadwood. Two months ago, even remotely positive economic statistics were isolated and seemingly random events. Now there is a steady stream of tiny glimmers of hope. The crackerjack Wall Street economic forecasting firm ISI Group pointed in an April 3 report to 38 such green shoots in global economic numbers. It concluded, "This probably means that the rate of decline in economic activity is moderating, but we do not believe that the economy is making a bottom." In other words, we haven't hit bottom but might be able to see it soon.

     

    However, if the economy doesn't begin its comeback by mid-2010, Obama's approval numbers and his party's prospects in the midterm elections could dramatically drop. Although he is a huge asset now, it's not hard to see how he could become a liability.

     

    Once a recovery begins, the danger becomes a "double dip." Recoveries can be extremely fragile. It doesn't take much for the economy to sink back into recession.

     

    In some ways, Democrats are in a good news/bad news situation. The good news for them is that the Republican Party still has horrific ratings -- 31 percent favorable, 58 percent unfavorable in the CBS/Times poll, compared with 56 percent favorable, 34 percent unfavorable for Democrats. And nothing the GOP is saying or doing is helping its cause.

     

    The bad news for Democrats is that midterm elections are rarely a referendum on the party out of power. The only exception that comes to mind is the punishment that the GOP took in 1998 for trying to oust President Clinton from office.

     

    For now, even though Obama and his party enjoy favorable ratings, the public does distinguish between the president and congressional Democrats. The budget package apparently took a bit of a toll on the popularity of congressional Democrats. On the generic ballot test, they are now running ahead of Republicans by only mid-single digits. That's not a sign of GOP recovery, but it could be an indication that some voters are having second thoughts about the Hill Democrats' enjoying such big majorities.

     

    Bottom line: Watch the economy, Obama's approval ratings, and the generic ballot test for clues about the environment in November 2010.

    Executive PayWatch: CEO Perks Rise as Workers’ Wages, Jobs Wilt  by James Parks

     

     

     

     

    Even as the U.S. economy went into a tailspin, the median salary for CEOs of 200 large corporations increased by 4.5 percent to $1.08 million. On top of that, these corporations keep plying executives with generous freebies, despite the public outcry over private jets and other executive perks.

    The 2009 AFL-CIO Executive PayWatch site, which launches today, points out that the perks for executives rose on average by 12.5 percent in 2008 to $336,248—or nine times the median salary of a full-time worker. Even more appalling is the practice of rewarding executives who drive their companies into the ground.

    For example, the site reports that in 2007—the year the financial crisis began to unfold—the top 10 recipients of the federal government’s Troubled Asset Relief Program (TARP) collectively paid their CEOs a combined $242 million in total annual compensation. That averages nearly $25 million per CEO to run companies that might have gone bankrupt if not for billions of dollars in taxpayer assistance.

    The PayWatch site also features an e-mail action. Click here to send a letter to Rep. Barney Frank (D-Mass.) and Sen. Christopher Dodd (D-Conn.), chairmen of the House Financial Services Committee and the Senate Banking, Housing and Urban Affairs Committee, respectively. Let them know we’re counting on them to draft legislation that truly strengthens our financial regulations and begins curing the disease that has infected our economic system.    

    This year’s Executive PayWatch highlights 10 case studies that show the multiple ways CEOs profited big time, while the average worker could barely hang on. There is the well-known case of AIG, which has been kept afloat by more than $170 billion in federal assistance—about  $1,500 for every household in the nation—and still paid out more than $500 million in salaries and bonuses to hundreds of senior employees.

    Here are other prime examples in the case studies of corporate failure:

    • While retirees worry over the fate of Deere & Co.’s pension surplus, which is shrinking because of stock market losses, the value of Deere CEO Robert Lane’s retirement income increased $5.5 million in fiscal 2008 to $22.5 million. Lane and other senior executives participate in not one but three different pension plans.

    • SunTrust Bank, which received $4.9 billion from the federal bailout fund, wants shareholders to approve a mega-grant of $7.7 million in stock options for James Wells, its chairman and chief executive officer, even as investors have lost billions.

    • While workers who are laid off in these tough economic times are lucky if they receive anything more than their last paycheck, Richard Bond, who retired as CEO of Tyson Foods in January, stands to collect more than $14 million in “golden parachute” severance payments.

    JUSTICE -- SIX BUSH OFFICIALS TO BE INDICTED BY SPANISH PROSECUTORS: Human Rights lawyer and Daily Beast contributor Scott Horton reports that Spanish prosecutors will announce today that they are moving forward with the indictment of six top Bush officials who are charged with providing legal cover for torture. The investigation deals specifically with the case of five Spanish citizens who were detained at Guantanamo Bay and allegedly tortured there. The Bush 6, as Horton calls them, are former attorney general Alberto Gonzales, former Undersecretary of Defense Douglas Feith, former Cheney chief of staff David Addington, Justice Department officials John Yoo and Jay S. Bybee, and Pentagon lawyer William Haynes. The State Department has been in constant contact with the Spanish government since the case was initially filed on March 17. During a meeting at the American embassy in Madrid, "Spanish prosecutors advised the Americans that they would suspend their investigation if at any point the United States were to undertake an investigation of its own into these matters." Horton reports, however, that when "pressed to know whether any such investigation was pending," they received no answer. Still, Obama  faces the ongoing issue of Republicans "promising to 'go nuclear' and filibuster" his legal appointments if he authorizes the Justice Department to release the torture memos written by the Bush 6.
     

    ECONOMY -- BUSINESS LOBBY GOES INTO HIGH GEAR TO PRESERVE OFFSHORE TAX DEFERRAL: Yesterday, both CQ and National Journal reported on the "tax battle" evidently looming between big business and President Obama, over his administration's proposal to begin taxing the profits that companies earn overseas. The business lobby is casting the proposal as a business-killing apocalypse. "Just imagine a world 10 years from now where there are no U.S. multinationals because they've all been bought up by foreign competitors," said tax lobbyist Kenneth Kies. "Everything else pales in comparison," said National Foreign Trade Council President William Reinsch, whose group is partnering with the Business Roundtable, the U.S. Chamber of Commerce, and the National Association of Manufacturers to preserve the deferral rule. The business lobby's rhetoric has been similar to that used by Sen. Orrin Hatch (R-UT), who warned that "companies are going to leave" because of Obama's "stupid, dumb-ass" tax proposals. But their fearmongering ignores the fact that U.S. corporate tax revenue as a share of the economy is below the Organization for Economic Cooperation and Development (OECD) average. The U.S. raises less revenue from corporations than do countries like the United Kingdom and Ireland, even with a technically higher rate. As the Wonk Room has noted, loopholes and shelters contribute to a skewed idea of what the U.S. corporate tax system really looks like, but suffice to say, it's not the crippling system that businesses make it out to be.
     

    RADICAL RIGHT -- DHS REPORT: AFTER OBAMA'S ELECTION, RIGHT-WING EXTREMISM 'MAY BE  GAINING NEW RECRUITS': The extreme right -- those who are "hate-oriented," "mainly antigovernment," or those dedicated to a "single issue" -- is a legitimate threat that law enforcement must deal with, according to a new assessment from the Office of Intelligence and Analysis at the Department of Homeland Security. The report, which was coordinated with the FBI and is being given to federal, state, and local law enforcement, warns, "The economic downturn and the election of the first African American president present unique drivers for rightwing radicalization and recruitment." Most extremists have made "rhetorical" statements and have "stopp[ed] short of calls for violent action," but since the 2008 election, right-wing extremists are "reaching out to a wider audience of potential sympathizers." The DHS under President Bush was apparently more reluctant to make such assessments about the right. According to CQ, a 2005 report outlining terrorist threats "does not mention anti-government groups, white supremacists and other radical right-wing movements." Conservative bloggers -- such as Michelle Malkin and Newsbusters -- are up in arms over the report. A DHS official responded to the right's criticism, noting that DHS did an assessment of left-wing extremism in January. "This is nothing unusual. ... This is about awareness," the official said.

    Republican National Committee Chairman Michael Steele has launched a direct attack on President Obama "in a new mass mailing, accusing the president of being part of the 'blame America first' crowd."
     

    Leaders of the nation's two major labor federations -- AFL-CIO president John Sweeney and Joe Hansen, a leader of the rival Change to Win federation -- said yesterday that they “have agreed for the first time to join forces to support an overhaul of the immigration system." The move “could give President Obama significant support among unions as he revisits the stormy issue in the midst of the recession."
     

    Former Bush press secretary Dana Perino is joining Mark Penn's public relations firm, Burson-Marsteller, as "chief issues counselor." Penn called Perino “an extremely skilled practitioner" who had weathered "some incredibly difficult experiences." Perino joins former Bush aide Karen Hughes, who also works at Penn's firm.

     

    Forty-one percent of Americans now believe that lower-income people are paying their "fair share" of federal taxes, up from 32 percent last year, according to a new Gallup poll. At the same time, just 23 percent say that upper-income taxpayers pay their “fair share," while 60 percent say they pay too little.

     

    More than a half the country's voting-age population used the Internet to get political news or get involved in the political process in 2008, according to a new survey conducted by the Pew Internet & American Life Project. "Nearly one in five (18%) internet users posted their thoughts, comments or questions about the campaign on an online forum such as a blog or social networking site."

     

    Homeland Security Secretary Janet Napolitano responded to criticism of a leaked DHS report on right-wing extremism, saying that "we are on the lookout for criminal and terrorist activity but we do not -- nor will we ever -- monitor ideology or political beliefs." In TV interviews today, she said "these are routine reports" that were "begun months ago, in fact, in preparation before this new administration took office."
